Court Dismisses Case Against MTS in Fletcher Sexual Harassment Suit

The court granted a dismissal of claims against the transit agency by its former employee, Grecia Figueroa 

San Diego – Today, the San Diego Superior Court granted a dismissal as a matter of law of all claims against the San Diego Metropolitan Transit System (MTS) in the Figueroa vs Fletcher case. All claims against the transit agency, including: sexual harassment, gender discrimination, and retaliation, were dismissed after the court’s review of evidence. 

“From the outset of this case, our Board was committed to an independent investigation and review of the matter,” said Stephen Whitburn, San Diego City Councilmember and MTS Board Chair. “We’re pleased to see the court’s agreement in dismissing charges against MTS.” 

“We were glad to hear today’s ruling in MTS’s favor,” said Sharon Cooney, MTS Chief Executive Officer. “As we put this case behind us, we remain focused on our ultimate mission to bring safe, reliable public transportation to our region.” 

In its summary judgment ruling, the court noted, in part, that “Defendant MTS has demonstrated the termination decision was based on legitimate, non-discriminatory reasons.” The ruling also found that “Defendant Fletcher did not supervise Plaintiff nor have any supervisory authority over Plaintiff, and Defendant MTS neither knew or should have known about Defendant Fletcher’s alleged harassing conduct prior to Plaintiff’s termination.”
